Copyright 2007, Seven Simple Machines, Inc. All rights reserved. THIS SOFTWARE IS PROVIDED TO YOU BY SEVEN SIMPLE MACHINES (“7SM”) UNDER THE TERMS OF THIS LICENSE AGREEMENT ("AGREEMENT"). YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT BY INSTALLING, USING OR REPRODUCING THE SOFTWARE. 1. RIGHTS 7SM grants you the following rights provided that you comply with all other terms of this Agreement. All rights not explicitly granted to you hereunder are reserved by 7SM. 1.1 INSTALLATION AND USE. You may install, use, and run one copy of this software on one or more computers provided that you only one copy is in use at a given time. The Software may not be used by more than the one person for whom it was licensed. 1.2 TRIAL PERIOD. You may use the trial version of this Software for a period of thirty (30) days without purchasing a single-user license. Once this trial period has ended you must either remove the software completely from all computers and destroy all copies of it or you must purchase a single-user license for each person who will be using it. 1.3 STORAGE FOR INSTALLATION. You may install a copy of the originally distributed installation package on a storage device, such as a networked computer, for the purposes of installing it on your workstation or other computers; however, you must acquire a single-user license for each person who will be using the software. 1.4 NO REVERSE ENGINEERING. You may not reverse engineer, decompile, or disassemble the Software. 1.5 NO RENTAL. You may not rent, lease, lend or provide hosting services (commercial or otherwise) for the Software. 1.6 TRANSFER OF LICENSE. You may transfer your license under this Agreement to a single other person provided that you remove and destroy all copies of the Software that you have installed for your use. The receiving user must agree to all terms of this Agreement prior to installation of the Software. 2. NO WARRANTY THIS SOFTWARE IS PROVIDED ON AN "AS IS" BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES OR CONDITIONS OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. You are solely responsible for determining the appropriateness of using this Software and assume all risks associated with its exercise of rights under this Agreement, including but not limited to the risks and costs of program errors, compliance with applicable laws, damage to or loss of data, programs or equipment, and unavailability or interruption of operations. 3. DISCLAIMER OF LIABILITY 7SM AND ITS AFFILIATES AND ASSOCIATES SHALL HAVE NO LIABILITY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING WITHOUT LIMITATION LOST PROFITS), HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OR MISUSE OF THE SOFTWARE OR THE EXERCISE OF ANY RIGHTS GRANTED HEREUNDER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
